What can I do with my Dubai apartment? Your Airbnb options by situation

Whether you can list your Dubai apartment on Airbnb depends on your specific situation: whether you hold a DTCM permit, whether you own or sublet, and whether your building allows short-term rentals. This guide covers five common owner situations and what the rules allow in each case.

The most common question Dubai property owners ask is not whether Airbnb is legal in Dubai, but whether it applies to their specific situation. An off-plan investor has a different position to someone whose long-term tenant has just left. An overseas national has different practical considerations to someone based in the UAE. This guide maps the five most common ownership scenarios against what DTCM rules actually permit and what you need to do next in each case. The one rule that applies to every situation

Before looking at individual scenarios, there is a single overarching requirement: every Dubai apartment rented on a short-term basis must hold a valid DTCM holiday home permit requirements. The permit is issued to the property owner by the Department of Economy and Tourism (DET, formerly known as DTCM) and is tied to the specific property address. Without a valid permit, listing on Airbnb, Booking.com, Vrbo or any other platform is illegal under Dubai short-term rental law. This is true regardless of how you came to own the property, how long you have owned it, or whether you use a management company.

A second rule applies at the building level. Some Dubai buildings, particularly those classified as hotel apartments, operate under a different licensing structure that restricts or removes individual owners’ ability to obtain independent permits. Always confirm your building’s classification before starting the permit application process.

Situation 1: you own the property outright and it is vacant

This is the most straightforward path. If you hold the title deed in your name, the property is clear of tenants, and the building is not classified as hotel apartments, you can begin the DTCM permit application immediately. The documentation required at application stage includes your title deed, a copy of your passport, proof of DEWA connection, and a floor plan if the building is not already in the DTCM system. Standard processing takes 2 to 4 weeks from submission.

Once the permit is issued, the property must pass a DTCM inspection before guests can be accepted. The inspection checks that the property meets the minimum furnishing and safety standards for a holiday home. If you are using a property management company with a DTCM operator licence, they can submit the application and manage the inspection process on your behalf.

Situation 2: your property is off-plan or not yet handed over

You cannot list an off-plan property on Airbnb before handover. The DTCM permit is linked to ownership as evidenced by a title deed registered at the Dubai Land Department. A sale and purchase agreement (SPA) with a developer does not qualify. Until the DLD has registered the transfer and issued the title deed in your name, no permit application can be submitted and no legal listing is possible. There is no provisional permit and no exception for properties near completion. Situation 3: your tenant has just left

When a long-term tenancy ends and the property is vacated, you can apply for a DTCM holiday home permit immediately. The prior tenancy has no bearing on your eligibility: the permit is tied to the title deed and the property address, not to its rental history. The application process is the same as for a vacant property owned outright. What does change is the property condition: an apartment that has been under a long-term tenancy for several years will typically need a full redecoration and furnishing refresh before it can pass the DTCM inspection, so build this into your timeline alongside the 2 to 4 week permit processing window.

One practical consideration: if your tenancy agreement included any clauses relating to what the owner may do with the property after vacancy (uncommon in Dubai but possible in some investor-owned buildings), check those clauses before proceeding. Situation 4: you are an overseas national or live outside the UAE

Dubai does not require the property owner to be a UAE resident to hold a DTCM holiday home permit or to list a property on Airbnb. Overseas nationals can own and legally list Dubai apartments on short-term rental platforms provided the usual permit and compliance requirements are met. The practical difference for overseas owners is management: you cannot personally handle check-in, guest communication, maintenance call-outs or inspection follow-ups from abroad. Most overseas owners appoint a property management company that holds its own DTCM operator licence. Situation 5: your property is in a hotel apartment building

Hotel apartments operate under a different licensing structure to standard residential buildings. Individual owners in a hotel apartment building cannot obtain an independent DTCM holiday home permit. The building must be enrolled in the hotel operator’s own permit scheme, and all short-term rental activity runs through that scheme rather than through individual DTCM permits. This is a fundamental difference, not a technicality: the application system at the DET portal will not allow a hotel apartment address to proceed through the standard holiday home permit application flow.

Situation 6: the property is co-owned or inherited

A co-owned or inherited Dubai property can be listed on Airbnb provided the title deed correctly reflects all owners at the Dubai Land Department and all named owners agree to the short-term rental use. For inherited property where the title has not yet been formally transferred into the heirs’ names, the permit application cannot proceed until the DLD transfer is complete.

For co-owned properties with multiple decision-makers, the management structure needs to be agreed before starting the process. If one owner is UAE-resident and the others are abroad, the resident owner can act as the local contact without this affecting the permit.
