In practice, the following categories of buildings are most likely to require a NOC: premium towers where the OA actively manages building reputation and guest quality, older buildings that adopted rules before short-term rental became prevalent and have not updated their bylaws, and mixed-use buildings where commercial and residential interests coexist. The first option is to challenge the OA decision through the RERA Owners Association dispute resolution process. This requires evidence that the refusal is unreasonable under the community bylaws. The second option is to request that the issue be placed on the agenda of the next General Assembly meeting, where unit owners vote on bylaw changes.
